# USDPAY — ACCEPTABLE USE POLICY

## 1. Purpose and Scope

This Acceptable Use Policy (the "Policy") is part of, and incorporated into, the USDPAY Terms of Service. It defines the categories of business activity that are permitted, restricted, or prohibited on the Platform. It applies to every Merchant and to all use of the Platform.

The Platform operates on a **whitelist principle**: only activities that clearly fall within the Permitted Categories (Section 3) are allowed by default. Any activity that is not clearly permitted is treated as restricted and requires review, or is prohibited.

## 2. Merchant Responsibility

The Merchant is solely responsible for ensuring that its business, its goods and services, and its acceptance of cryptocurrency are lawful in the Merchant's jurisdiction and in the jurisdictions of its Customers. Approval or onboarding by USDPAY is **not** a determination that the Merchant's activity is legal anywhere. USDPAY does not provide legal, tax, or compliance advice.

## 3. Permitted Categories (Green — generally eligible)

The following categories are generally eligible for automatic onboarding, provided the Merchant complies with all applicable law:

- Software, SaaS, and subscriptions; APIs and developer tools
- Web hosting, VPS, servers, domains, CDN, and related infrastructure
- eSIM, data packages, and mobile top-ups
- Digital content: templates, presets, fonts, stock assets, game/design assets
- Online education, courses, tutorials, and skills-based coaching
- Custom development, design, copywriting, editing, and marketing services
- Media subscriptions and paid communities (non-adult)
- Tickets to online events and webinars
- Ordinary non-food retail goods: apparel, accessories, gadgets, merchandise, books
- B2B services: analytics, automation, integrations, and consulting on non-regulated topics

## 4. Restricted Categories (Yellow — review required)

The following categories are **not permitted by default**. They may be considered only after manual review and approval, may require the Merchant to hold and evidence its own applicable licenses, and may be subject to geographic restrictions and additional compliance conditions. Using the Platform for these without prior written approval is a breach of the Terms.

- Gambling, betting, lotteries, social casino, and loot-box mechanics
- Any financial activity: crypto exchange, brokerage, forex, "investment," yield, lending, or staking-as-a-service
- Adult content (lawful)
- Healthcare, prescription products, supplements, telemedicine, and pharmacies
- Tobacco, vaping, alcohol, and cannabis/CBD (where lawful)
- Weapons, ammunition, and tactical equipment
- Travel agencies, charters, and tour operators
- Donations, crowdfunding, and fundraising
- Marketplaces or platforms aggregating many third-party sellers
- Nutraceuticals, weight-loss, and products making health claims

## 5. Prohibited Categories (Red — never permitted)

The following are strictly prohibited. Accounts engaging in them will be suspended or terminated immediately, and may be reported to the appropriate authorities:

- Money laundering, mixers, tumblers, or any activity designed to obscure the origin of funds
- Narcotics, controlled substances, or precursors
- Weapons or explosives outside any lawful, licensed context
- Any content or activity that exploits or endangers minors (including CSAM)
- Human trafficking or exploitation
- Fraud, phishing, carding, stolen data or credentials, or counterfeit goods
- Sanctions evasion or transactions with sanctioned persons, entities, or jurisdictions
- Any activity that is illegal under applicable law

## 6. Category Declaration and Screening

6.1 During onboarding, the Merchant must select an accurate business category and truthfully describe its activity. Providing false or misleading category information is a material breach.

6.2 We may use automated checks (including keyword screening of business descriptions and URLs) and manual review to classify or re-classify a Merchant's activity.

6.3 We may request additional documentation (including evidence of any license required for the Merchant's activity) at any time as a condition of continued access.

## 7. Enforcement

7.1 We may, at our discretion and without liability, place an account under review, restrict features, suspend, or terminate an account that we reasonably believe violates this Policy or applicable law, or that presents undue legal or reputational risk.

7.2 Because the Platform is non-custodial, enforcement affects **access to the Platform only**. USDPAY does not hold Merchant or Customer funds and cannot freeze, seize, or return any on-chain payment.

## 8. Reporting Violations

Suspected violations of this Policy may be reported to **support@usdpay.me**. We review reports and take action as appropriate.

## 9. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date reflects the latest revision. Continued use of the Platform after changes take effect constitutes acceptance.
